DMCA Policy

About this Policy

Effective date: November 6, 2026 · Last updated: November 6, 2026 · Version: 1.0.0

AguiCorp, LLC ("AguiCorp," "we," "us") respects the intellectual property rights of others and expects users of MyHappySky at https://www.myhappysky.com (the "Service") to do the same. This Policy describes how AguiCorp responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA").

1. Safe Harbor and Policy Scope

AguiCorp qualifies for the safe harbor protections of 17 U.S.C. § 512 as a provider of online services, including hosting and transmission of user-submitted material. This Policy sets out the procedure by which:

  • a copyright owner (or their authorized agent) may notify us of allegedly infringing material on the Service;
  • a user whose material has been removed may submit a counter-notification;
  • AguiCorp will act on properly submitted notices.

The Service does not accept uploads, posts, or comments from users today. Words or pictures a parent adds to the free tools stay on the parent's own device and are not hosted by us. This Policy applies to the Service's own content and to any user-submitted features we add later, as our Terms of Service describe.

2. Designated Copyright Agent

AguiCorp's Designated Copyright Agent for receiving DMCA notifications is:

AguiCorp, LLC — DMCA Agent

  • Email: [email protected]
  • Mail: AguiCorp, LLC, Attn: DMCA Agent, P.O. Box 620101, Orlando, FL 32862, USA
  • Phone: 407-751-1551

Our Designated Agent is registered with the U.S. Copyright Office under registration DMCA-1071130. Only notices sent to the Designated Agent are deemed received for purposes of 17 U.S.C. § 512. Notices sent to any other address, inbox, or contact form may not be acted upon.

3. Notice of Alleged Infringement

To file a notice of alleged copyright infringement, send the Designated Agent a written communication that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single site are covered by a single notification, a representative list of such works);
  3. Identification of the material that is claimed to be infringing or the subject of infringing activity and is to be removed or disabled, with information reasonably sufficient to permit us to locate the material (ideally including the full URL);
  4. Information reasonably sufficient to permit us to contact the complaining party, including an email address, mailing address, and if available, a telephone number;
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Warning — Material Misrepresentation (17 U.S.C. § 512(f)). Any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees incurred by the alleged infringer, by any copyright owner, by any copyright owner's authorized licensee, and by AguiCorp.

4. Our Response to a Valid Notice

Upon receipt of a notice that complies with Section 3, we will:

  1. Remove or disable access to the material identified in the notice, expeditiously;
  2. Take reasonable steps to notify the user who submitted the material that it has been removed or disabled, with a copy of the notice;
  3. Terminate repeat infringers' access to the Service, as described in Section 7.

If a notice is incomplete or deficient under Section 3, we may contact the sender to request a corrected notice, or we may decline to act on it. A deficient notice is not deemed received for § 512(c)(3) purposes.

5. Counter-Notification

A user whose material has been removed or disabled may submit a counter-notification to our Designated Agent. A counter-notification must include all of the following, as required by 17 U.S.C. § 512(g)(3):

  1. A physical or electronic signature of the user;
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement, under penalty of perjury, that the user has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. The user's name, mailing address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the user's address is located, or if the user's address is outside the United States, for any judicial district in which AguiCorp may be found, and that the user will accept service of process from the person who provided notification under Section 3 or an agent of that person.

Warning — Material Misrepresentation. The same § 512(f) liability described above applies to a knowing material misrepresentation in a counter-notification.

6. Our Response to a Counter-Notification

Upon receipt of a counter-notification that complies with Section 5, we will:

  1. Promptly provide the complaining party with a copy of the counter-notification;
  2. Inform the complaining party that we will restore or re-enable access to the removed material in not less than 10 and not more than 14 business days following receipt of the counter-notification;
  3. Restore or re-enable access to the removed material within that 10-to-14-business-day window, unless we first receive notice from the complaining party that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Service.

This process is mandatory under 17 U.S.C. § 512(g)(2)(C). We do not have discretion to withhold restoration if the statutory conditions are met and no suit is filed within the window.

7. Repeat Infringer Policy

AguiCorp will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright, as required by 17 U.S.C. § 512(i)(1)(A).

We maintain an internal record of DMCA notices received and the users to whom they relate. A user who is the subject of multiple valid DMCA notices will have their account terminated. "Multiple" and "appropriate circumstances" are evaluated in good faith by AguiCorp considering the frequency, severity, and nature of the notices and any counter-notifications filed.

Termination under this Section may be accompanied by removal of the user's content, forfeiture of any subscription fees paid, and a ban on creating new accounts on the Service or any other AguiCorp property.

8. False or Abusive Notices

Submitting a false notice or counter-notification is a federal offense that may expose the submitter to civil liability under 17 U.S.C. § 512(f) and may be referred to law enforcement. We retain all notices and counter-notifications received, together with records of our responses, as evidence of our good-faith compliance with the DMCA and for use in any resulting proceeding.

9. Other Intellectual Property Claims

This Policy addresses copyright claims only. Trademark, patent, trade-secret, right-of-publicity, and other intellectual property claims should be addressed to [email protected] with the subject line "IP Claim — [brief description]."

10. Changes and Contact

We may update this Policy as the Service evolves or as the law requires. Material changes are announced on this page with a new version number and effective date.
